MEDICAL SURVEILLANCE

  1. A program of medical surveillance must be provided for employees exposed to applicable hazards and toxic substances.  This program shall consist of the initial and periodic medical examinations of the frequency specified by the applicable OSHA standards.

  1. All medical examinations and procedures must be performed by or under the supervision of a licensed physician, and must be provided without cost to the employee.

  1. A record for each employee subject to medical surveillance shall include:

  1. Copy of the physician’s written opinion or employee refusal to take the medical examination.

  1. Any medical complaint by the employee related to exposure to the toxic substance or hazard.

  1. A copy of the required information pertaining to employee exposure which the employer must provide to the physician.

  1. A copy of the employee’s work history.

This record is maintained for a minimum of 40 years or for the duration of employment plus 20 years which ever is longer, as specified in the applicable OSHA standard.  At the expiration date of the retention period the agency must transmit these records to the Director of the National Institute for Occupational Safety and Health, U.S. Department of Health and Human Services.
